California Notice 2012-12: Notice of Existing Stocks Policy for Amended Product Labels

Effective October 17, 2012, the Department of Pesticide Regulation (DPR) will allow registrants to continue selling and distributing EPA registered pesticide products carrying a previously DPR-approved amended product label in California. The sale, however, must be consistent with EPA’s current stock provisions.

If a registrant sells an EPA registered product displaying a previously approved label when a new amended label for the same product is on file with DPR, the registrant must be prepared to show that the sale was made within the period allowed by EPA’s existing stocks policy in order to avoid liability for a misbranded sale.

DPR is encouraging registrants to submit amended pesticide labels to DPR for authorization immediately after federal approval.
