STATE PESTICIDE REGULATION

All pesticide products must be registered by the Federal government under FIFRA. HOWEVER, once a federal pesticide registration is approved, registration approvals must be obtained form EACH AND EVERY STATE AND TERRITORY where the product will be marketed. TSG has the oldest, largest, and most experienced state compliance program for pesticides.

TSG's State Affairs Division, with offices close to Sacramento, focuses on state compliance needs, including a comprehensive program on pesticides.

TSG's state pesticide compliance programs include:

  • 50-State pesticide registration programs.
  • 50-State pesticide renewals.
  • California DPR Registrations.
  • Compliance with California 's Proposition 65.
  • Registrations unique to states such as New York, Florida, and Hawaii. States other than California have compliance programs and traditions that make registrations within their jurisdictions uniquely challenging. TSG has over 20 years of experience with all the states' unique personalities and challenges.
  • Data Generation. The EPA is not the only agency that requires supporting scientific data to register pesticides. States such as California , New York and Florida also get involved in mandates for data. TSG develops and implements strategies for ensuring that your data packages are designed to meet the demands of all agencies, whether Federal or State.
  • Enforcement. State governments are the enforcement agencies of FIFRA. As a result, it is more likely to get a “call” from a state agency regarding your products, their registration status, or problems with their use, than it is to get a call from the Federal EPA. The TSG State Affairs Division has extensive experience in assisting pesticide registrants through enforcement actions at the state levels.

With 50 states and the attention of the general public on pesticides, the defense of products at the state level is expanding. States that previously depended on Federal compliance as their foundation are finding it appropriate to independentlv evaluate pesticide issues within their jurisdictions, from groundwater and air quality concerns to public health issues. TSG has experience in product defense and the need to coordinate these efforts with the actions of the EPA.
