California OEHHA Proposes New Proposition 65 Warning Regulations (January 2015)

California’s Office of Environmental Health Hazard Assessment (OEHHA) provided a Notice of Proposed Rulemaking for Article 6 regulations governing “clear and reasonable” warnings under Proposition 65. The new regulations are designed to further the “right-to-know” intentions of the statute by addressing the content of safe harbor warnings for various exposure scenarios and the method in which they are provided. The proposed regulations would require more detailed information in Proposition 65 safe harbor warnings, including how to avoid or reduce exposure to listed chemicals, and more specificity regarding the minimum elements for providing a “clear and reasonable” warning for exposure from various products and environmental settings.

Public Hearing & Comment Period
A public hearing will be held on March 25, 2015 to discuss the proposed regulatory action. The public hearing will be held in the Coastal Hearing Room, Cal-EPA Building in Sacramento, CA from 10am-12pm PT.

A written public comment period is open until April 8, 2015.
