EPA Increases FIFRA Violation Fees (July 2016)

On July 1, 2016 the U.S. Environmental Protection Agency (EPA) published an interim final rule announcing that it is increasing maximum civil penalties for violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) from $7,500 to $18,750 per violation.

EPA is authorized by FIFRA §13 and §14 to take necessary enforcement against pesticides that do not adhere to requirements in the act. EPA outlines some of these actions on their website, which include “conduct[ing] producer establishment inspections, marketplace surveillance, and pesticide sampling and analysis” to ensure that pesticide products are being used, sold, and distributed safely and legally.
