CA DPR Extends Filing Deadline for Impregnated Materials (October 2016)

California’s Department of Pesticide Regulation (DPR) is extending the deadline for companies to file applications to register pesticide impregnated materials under California Notice 2015-13. The deadline to file product registration applications is being moved from November 1, 2016 to March 1, 2017.

DPR currently registers manufactured items and materials bearing pesticidal claims. These registrations are usually done by the manufacturer of the pesticide used to impregnate the material, or by the company performing the impregnation of the materials. California Notice 2015-13 was issued to inform companies selling impregnated products that all products would soon need to be registered as pesticides. DPR is requiring each company to register products under each use category. Use categories for impregnated materials include:

  • Apparel (e.g. jackets, shirts, hats, pants, shorts)
  • Non-apparel (e.g. bedding, tents, shower curtains)

This action is consistent with the efforts of DPR and the United States Environmental Protection Agency (EPA) to coordinate labeling requirements on both the federal and state level for retailer and brand partners. A labeling guidance will be provided to registrants once a final agreement is reached.
