CALIFORNIA AUXILIARY SOIL & PLANT SUBSTANCE (ASPS) REGISTRATION

Microbial or biochemical products often have claims and data that make ASPS registration by California 's Department of Food and Agriculture (CDFA) the most efficient path to market. Similar products often have data and claims that trigger registration as a fungicide or plant growth regulator by the Department of Pesticide Regulation (DPR). TSG has extensive experience with ASPS products as well as pesticides.

ASPS products include microbial inoculants and products, other biotics, lignin or humus, and “any similar product intended to be used for influencing soils, plant growth, or crop or plant quality”, but they exclude commercial fertilizers, agricultural minerals, economic poisons, soil amendments, and manures.

Classification of products as ASPS rather than other fertilizing material or pesticide categories is often determined by product claims. Technology Sciences Group (TSG) has the expertise to efficiently guide registrants on ASPS registrations including those with active ingredients requiring efficacy data. TSG is experienced registering products

  1. exempted from efficacy data requirements
  2. requiring efficacy reports based on:
    1. field trial data
    2. public literature data.

TSG helps develop product claims that are appropriate and that do not invite pesticide enforcement actions. TSG provides experience clear guidance (1) consistent with CDFA requirements for ASPS products and (2) not overlapping with DPR definitions of pesticidal products.
